Abstract:  The Outer Continental Shelf Lands Act (OCSLA) requires pipelines to provide open and non-discriminatory access to shippers of production.  The Federal Energy Regulatory Commission (FERC) has historically enforced this provision through is enforcement of the Natural Gas Act (NGA) and the Interstate Commerce Act.  Beginning in the 1990s, FERC began relinquishing NGA jurisdiction over some of these pipelines.  FERC contended it still maintained authority under OCSLA, however, the Courts have ruled otherwise.  In order to provide shippers with a methodology to file complaints alleging denial of access or discriminatory access, MMS is proposed regulations to fill this regulatory gap
